The Government of the Republic of Hungary and the Cabinet of Ministers of Ukraine (hereinafter referred to as the Contracting Parties)
Having regard to Regulation (EC) No 1931/2006 of the European Parliament and of the Council of 20 December 2006 laying down rules on local border traffic at the external land borders of the Member States and amending the provisions of the Schengen Convention;
Having regard to Council Regulation (EC) No 1932/2006 of 21 December 2006 amending Regulation (EC) No 539/2001 listing the third countries whose nationals must be in possession of visas when crossing the external borders and those whose nationals are exempt from that requirement;
Adopting the fact that it is in the interest of the European Union to ensure that the borders with its neighbours are not a barrier to trade, social and cultural interchange or regional cooperation, and that the European Union recognises the introduction of a visa free travel regime for the citizens of Ukraine as a long term perspective;
Driven by desire to strengthen good neighbourhood relations between the states of the Contracting Parties in accordance with regulations of the Agreement between the Republic of Hungary and Ukraine on the bases of good neighbourhood and co-operation of 6 December 1991, and to mutually facilitate border crossing of border residents;
Have decided to conclude agreement on local border traffic in the interest of border residents, thus have agreed as follows:
Article 1
(1) Persons who have had permanent residence for at least three years (hereinafter referred to as border residents) in settlements along the state border listed in Annex I of the present Agreement (hereinafter referred to as border area) are allowed to enter and stay in possession of local border traffic permit (hereinafter referred to as permit) as defined in Article 2 without any further permission in the border area of the state of the other Contracting Party.
(2) Provisions of the present Agreement also apply to the spouse, minor or dependant major child (including adopted or foster child) and minor or dependant major child (including adopted or foster child) of the spouse of the person defined in paragraph (1) of this Article, even if they have had permanent residence for less than three years in the border area.
(3) Border residents shall prove their permanent residence status in the border area with documents listed in Annex II of the present Agreement.
(4) Crossing of border of the state of the other Contracting Party under the local border traffic regime - even in case of fulfilment the requirements defined in paragraphs (1) and (2) - is only possible, if border residents are not considered to be a threat to public policy, internal security, public health or the international relations of the states of the Contracting Parties, and in particular are not subject to any expulsion or ban on entry or stay on the same grounds.
(5) The permit as defined in Article 2 entitles its holder for multiple entry and for a continuous stay of maximum three months within six months in the border area of the state of the other Contracting Party, in particular for social, cultural or family reasons, or substantiated economic reasons that are not to be considered as gainful activity according to national regulations. Border residents travelling with the permit are not allowed to stay outside the border area of the state of the other Contracting Party.
Article 2
(1) The permit is a special document issued by the competent authorities of the states of the Contracting Parties containing security features and technical specifications complying with the relevant provisions of the European Union and with the national regulations of the states of the Contracting Parties. The permit entitles its holder to enter, stay for definite reason and in definite area, and exit. Local border traffic permit is issued by the authority of the country of entry and it is valid for at least one year and not more than five years, but it can not exceed the validity of the travel document.
(2) The permit shall contain:
(a) facial image of the holder of the permit;
(b) the forename(s), surname(s), date of birth, nationality and place of residence of the holder of the permit;
(c) the issuing authority, date of issue and period of validity;
(d) the border area within which the holder of the permit is authorised to move;
(e) the number(s) of the valid travel document entitling its holder to cross external borders;
(f) clear statement that its holder is not authorised to move outside the border area and that any abuse shall be subject to penalties as provided for in Article 3.
(3) The permit shall be issued within the shortest possible period of time, but not more than thirty (30) days from the date of submitting the application.
(4) The Contracting Parties shall exchange the specimens of the permits. The Contracting Parties shall notify each other about the change of the permits through diplomatic channels without delay, and they shall exchange the specimens of the new permits. Valid documents can be used until the end of their validity.
(5) The permit shall be issued in the official language of the issuing state of the Contracting Party, as well as in English language.
(6) The fee of the permit shall amount to twenty (20) euros. Fees for the permit are waived for the following categories of persons:
(a) disabled persons;
(b) pensioners;
(c) children under the age of 18 and dependent children under the age of 21.
(7) Detailed rules of issue of the permit and rules of data management and supply of data related to the issue are to be determined by the Contracting Parties according to their national regulations.
(8) Authorities entitled to take over applications for permits are listed in Annex III of the present Agreement.
Article 3
(1) During their stay in the territory of the state of the other Contracting Party under the local border traffic regime, border residents shall abide by the laws and regulations of this state.
(2) The states of the Contracting Parties impose penalties determined by their national regulations in case of any kind of misuse of the permit. Penalties that may be imposed by the states of the Contracting Parties as determined by their national regulations are listed in Annex IV of the present Agreement. The Contracting Parties shall inform each other about the amendments of national regulations of their states concerning penalties through diplomatic channels.
